On 26 February 2010, the Crown recognised a mandate for Te Komiti Nui o Ngāti Whakaue to negotiate a settlement for outstanding historical Treaty of Waitangi claims on behalf of Ngāti Whakaue.

The Crown and Te Komiti Nui signed Terms of Negotiation in 2014. Negotiations continued until 2016, when they were paused due to differing positions between the Crown and Te Komiti Nui.

In July 2022, Te Komiti Nui wrote to the Minister for Treaty of Waitangi Negotiations requesting to re-engage with the Crown. The Minister responded that given the length of time elapsed since recognising the Te Komiti Nui mandate, formal steps would be needed to reconfirm the mandate prior to re-entering negotiations.

Te Komiti Nui, in consultation with the Office for Māori Crown Relations – Te Arawhiti, has prepared a draft Deed of Mandate which sets out their representative structure. The draft Deed of Mandate was discussed and voted on by the Ngāti Whakaue claimant community at hui in Auckland, Hamilton, Maketū and Rotorua between 22 and 27 July 2024.

Te Arawhiti is seeking the views of the Ngāti Whakaue claimant community on the draft Deed of Mandate (documents available to view here), including the hui and voting process carried out by Te Komiti Nui.

After reviewing and considering any comments received on the draft Deed of Mandate, Te Arawhiti in consultation with Te Puni Kōkiri will provide advice to the Ministers for Treaty of Waitangi Negotiations and Māori Development. These Ministers will decide whether to recognise Te Komiti Nui as having received a reconfirmed mandate to negotiate on behalf of Ngāti Whakaue.
