Overview

The Ministry of Justice has been looking at ways to improve out of court dispute resolution.

Consultation on a proposed adjudication framework

We are interested in what you think about a proposal for a statutory adjudication framework that would give businesses a new way to resolve civil disputes quickly and privately, instead of filing a claim in court or going to arbitration. Over time, this could be extended to other civil claims.

What is adjudication?

Adjudication is a process where parties ask a qualified and neutral third party in the private sector (an adjudicator) to make a fast decision on a business-related dispute.

Providing a statutory framework for adjudication would make decisions legally enforceable.

An adjudication framework with broad application would be a world first. We need your feedback on the proposals in the consultation document to help us prepare advice for the Government on the detailed proposals that would form the basis for a possible Adjudication Act.

What happens next 

Your feedback will inform policy advice to the Minister of Justice. After this, the Government may develop a Bill and introduce it to Parliament. If so, you will have an opportunity to provide further feedback on specific policy proposals when the Bill goes through the select committee process.
